Representative Yadira Caraveo and Senator Paul Lundeen "Regulate Marijuana" Bill which:
- Arbitrarily caps THC at 15%
- Creates authority for INDIVIDUAL standardized marijuana serving size amount
- - 5mg thc for liquid
- - 10 mg thc for all other products
- shall not require cutting, breaking, dividing, separating, or measurement
- Sets up seed-to-sale tracking on MMJ patients & Drs

- any data necessary to ensure a patient isn't visiting multiple MMJ stores to purchase product

- Repeals law to to use vendor machine for cannabis
- Prohibits retail & medical marijuana stores to sell product that contains butane, propane, or known human carcinogen
- including cultivation and manufacturing facilities
- Prohibits adult use shatter, wax, or products with a nationally recognized brand
- Prohibits MEDICAL sales of wax, shatter, anal, and vaginal suppositories
- Requires more labeling
- Dr must certify to the CDPHE per each MMJ recommendation
- every practitioner who makes MMJ recommendations shall register and maintain a user account within the seed-to-sell tracking system
- after the system is in place a Dr or MMJ store can authorize 3 designees to access the seed-to-sell tracking system on behalf of the Dr or MMJ store
- MMJ Drs certification must include -
- date of issue
- effective date
- patient's name and address
- authorizing physician's name address
- Federal drug enforcement agency number
- Potency level recommended
- The dosage form
- The quantity authority
- Directions for use
- Number of refills
- MMJ physicians shall maintain a record keeping system
- Dr or MMJ stores can be subject to fines if reasonable steps to ensure that the designee is sufficiently competent in the use of the MMJ program
- Dr and each MMJ stores shall disclose to a patient that his or her identifying recommendation information will be entered into the seed-to-sale tracking system
- WHO can SEE this INFO = STATE LICENCING AUTHORITY is responsible for administering the system -
- Doctor who prescribes controlled substances
- Any doctor engaged in a legitimate program to monitor a patient's drug use
- A medical director at a facility that treats substance abuse disorder
- LAW ENDORSEMENT
- State Regulatory boards within the department of regulatory agencies
- A resident physician with an active physicians training license
- Psychiatrists
- CDPHE for purposes of population level analysis
- State licensing authority or Department of Health and Care Policy and Financing may provide data to qualified personnel to a public or private entity for purpose of research or education, and provide the means of sharing information about individuals in the program with OUT-OF-STATE Health Care Practitioners and LAW ENFORCEMENT
- WHO can SEE this INFO = STATE LICENCING AUTHORITY is responsible for administering the system -
- The State licensing authority can accept gifts, grants, donations from any public or private entity for the purpose of implementing and maintaining the seed-to-sale MMJ use monitoring program fund
- State licensing authority shall report annually to Health and Human Services Committee of Senate and Health Insurance Committee of the House of Representatives regarding gifts, grants, and donations
- If there's insufficient money to maintain the marijuana monitoring program the State licensing authority can collect annual fees from each Medical Marijuana store
- Record toxicology report on any autopsy conducted where a death occurred due to suicide, overdose death, or accidental death
- Record ER toxicology reports of any conditions that may reflect marijuana use.
